The Jehovah's Witnesses refused to partake in government, bear arms or serve in the military, or salute the flag. Being forced to salute the flag is forbidden because it constitutes idol worship and also is forbidden by the Bible. West Virginia felt everyone in public schools should and if the child disobeyed, they was punished. The child was expelled from school and their parents had to go to jail for 30 days and had to pay a $50 fine. Barnette and her children refused to salute the flag. She sued in federal district court for an injunction against the enforcement of the flag salute law. The state Board of Education appealed directly to the United States Supreme Court.
